Today, Sens. Fischer and Donnelly introduced the Fair Agricultural Reporting Method Act (FARM Act) that clarifies farmers and ranchers do NOT need to report animal waste emission under CERCLA. While this is a good start in fighting what would have been a nonsensical regulation, the legislation still needs support from Colorado’s senators.

CERCLA provides a vastly important service in the reporting of hazardous materials being introduced into the environment from events like oil spills and chemical discharges. And it rightly holds the responsible party financially liable if one of these dangerous accidents were to occur. However, this legislation was never intended to be broadened to include the regulation of animal waste.
